Subscription Agreement

Introduction and Acceptance

This Subscription Agreement governs your subscription to the premium features and services of the fioilt app, an AI-powered application designed to transform everyday photos into oil-painting style artworks. The App is developed and operated by the developer. By subscribing to the Premium Subscription, you agree to be bound by all the terms and conditions set forth in this Agreement, as well as the User Agreement of the App. If you do not agree to any part of this Agreement, you must not subscribe to the Premium Subscription or use any of its premium features.

The Premium Subscription is optional, and the App remains fully usable with its basic features without a subscription. This Agreement explains the terms of your Subscription, including subscription plans, payment terms, renewal, cancellation, and our ongoing commitment to protecting your privacy, particularly with regard to facial data.

We do not collect any facial data from you at any time, even when you subscribe to the Premium Subscription. This commitment is a core principle of the App’s design and applies to all users, whether using the basic free features or the Premium Subscription. We never gather, store, process, or transmit any facial information, facial features, facial recognition data, or any biometric data related to your face, regardless of whether you use photos that contain human faces or take new photos with the App’s camera function. Even if the photos you upload or capture include facial images, our App does not extract, analyze, or retain any facial-related information from those photos. All processing of your photos, including the AI stylization into oil paintings (whether using basic or premium features), is completed locally on your device, and no facial data is ever collected, saved, or sent to any external servers or third parties. We do not use any facial recognition technology, nor do we have any functions or mechanisms designed to collect or process facial data in any form. Your facial privacy is fully protected, and your Subscription does not involve any collection or processing of facial data.

No Account Required for Subscription

Consistent with the App’s design, the Premium Subscription does not require any account registration, login, or authentication. You can subscribe to the Premium Subscription directly through your device’s official app store (e.g., Apple App Store, Google Play Store) without providing any personal information such as your name, email address, phone number, or any other identifying details. The subscription process is tied to your device’s app store account (e.g., Apple ID, Google Account) solely for payment processing purposes—we do not have access to, collect, or store any information related to your app store account, and we do not operate any separate user account system for the App or the Premium Subscription.

We do not collect any facial data, and the absence of an account requirement for Subscription further reinforces this commitment. Since no account is required to subscribe or use the Premium Subscription, we have no mechanism to associate any data with your personal identity, including facial data. We never ask for, collect, or store any biometric data, including facial information, at any stage of the subscription process or during your use of the Premium Subscription. Whether you use the Premium Subscription occasionally or regularly, your facial data remains completely private and uncollected by our App. We do not use facial data for any purpose related to your Subscription, including subscription verification, usage tracking, or feature optimization, as we do not collect it in the first place.

Subscription Plans and Premium Features

We offer various Premium Subscription plans, which may include monthly, annual, or other periodic subscriptions. The specific details of each Subscription Plan, including pricing, duration, and included premium features, are displayed in the App and/or the applicable app store at the time of subscription. By selecting a Subscription Plan, you agree to the pricing and terms of that specific plan.

Premium features may include, but are not limited to, access to additional oil-painting styles, high-resolution image generation, ad-free usage, advanced image editing tools, and priority technical support. The availability of premium features may be updated or modified from time to time, and we will notify you of any significant changes to the premium features included in your Subscription Plan.

We do not collect any facial data in connection with the Premium Subscription or its features. All premium features, including advanced AI stylization, high-resolution generation, and image editing, operate entirely locally on your device and do not involve any collection of facial data. Even when using premium features to process photos that contain facial images, the App does not extract, collect, or store any facial data from those photos. The premium features are designed to enhance your creative experience without compromising your privacy, and no facial data is ever collected or processed as part of these features. We do not use facial data to restrict or enable access to any premium features, as we do not collect such data.

No Age Restrictions for Subscription

There are no age limitations or restrictions for subscribing to the Premium Subscription. Any individual, regardless of age, may subscribe to the Premium Subscription without providing proof of age or obtaining parental/guardian consent. We do not collect any age-related information from users, as no such information is required to subscribe to or use the Premium Subscription, and we do not impose any age-based restrictions on access to the Premium Subscription or its features.

We do not collect any facial data from users of any age who subscribe to the Premium Subscription. Regardless of your age, if you use photos that contain facial images (either by selecting them from your photo library or capturing them with the App’s camera) while using the Premium Subscription, the App will not extract, collect, or store any facial data from those photos. We do not have any age-specific policies related to facial data collection because we do not collect facial data from any user, regardless of their age. All subscribers, regardless of age, enjoy the same level of facial privacy protection, as no facial data is ever collected by the App or in connection with the Premium Subscription.

Payment Terms

By subscribing to a Premium Subscription Plan, you agree to pay the applicable subscription fee (as displayed at the time of subscription) to the app store through which you subscribed (e.g., Apple App Store, Google Play Store). The subscription fee is non-refundable, except as required by applicable law or the app store’s refund policies. We do not process any payment information directly—all payment processing is handled by the applicable app store, and we do not collect, store, or process any credit card information, bank details, or other payment-related data.

The subscription fee is charged at the time of initial subscription and, unless canceled, will be automatically charged at the start of each subsequent subscription period (e.g., monthly, annually) in accordance with your selected Subscription Plan. The app store will notify you of upcoming automatic renewals and any changes to the subscription fee, in accordance with the app store’s policies.

We do not collect any facial data in connection with payment or subscription processing. Since all payment processing is handled by the applicable app store, we do not have access to any of your payment information, and we never collect any facial data as part of the payment or subscription process. The app store’s payment processing does not involve any facial data collection by us, and we do not request or collect any facial data to verify payments or process subscriptions. Your facial privacy remains protected throughout the entire payment and subscription process, as no facial data is ever collected.

Subscription Renewal and Cancellation

Your Premium Subscription will automatically renew at the end of each subscription period, unless you cancel the subscription before the start of the next period. You may cancel your subscription at any time through the applicable app store’s subscription management settings. Cancellation will take effect at the end of the current subscription period—you will continue to have access to the Premium Subscription features until the end of the period for which you have already paid, and no refunds will be provided for any unused portion of the subscription period, except as required by applicable law or the app store’s refund policies.

We reserve the right to modify or discontinue any Subscription Plan at any time, but we will provide reasonable notice to subscribers of any significant changes to their Subscription Plan, including changes to pricing or premium features. If we discontinue a Subscription Plan, you will not be charged for subsequent renewal periods, and you will have access to the premium features until the end of your current subscription period.

We do not collect any facial data during subscription renewal or cancellation. Cancellation is handled entirely through the applicable app store, and we do not collect any facial data or other personal information as part of the cancellation process. When you cancel your subscription, we do not retain any of your data, including any facial data (which we never collected in the first place). Your cancellation does not affect our commitment to not collecting facial data, and no facial data is ever collected or retained during or after the cancellation process.

User Content and Intellectual Property

“User Content” refers to any photos you select from your device’s photo library, any photos you capture using the App’s camera function, and any oil-painting style images generated by the App (whether using basic or premium features). You retain full ownership and all rights to your User Content. We do not claim any ownership or intellectual property rights over your User Content, and we do not collect, store, or transmit your User Content to any external servers or third parties, regardless of whether you have a Premium Subscription.

The App itself, including but not limited to its software, code, algorithms, design, interface, logos, premium features, and all intellectual property rights related thereto, are owned by us or our licensors. Your Premium Subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the premium features of the App for personal, non-commercial purposes only. You may not copy, modify, distribute, reverse engineer, decompile, disassemble, or create derivative works of the App or any part thereof, without our prior written permission.

We do not collect any facial data from your User Content, whether you are using basic or premium features. Even if your User Content includes photos with facial images, we do not extract, analyze, or retain any facial data from those images. The AI model used to generate oil-painting style images (including premium styles) processes the entire photo locally on your device to apply the stylization effect, but it does not collect, extract, or store any facial data. Your User Content remains on your local device, and no facial data is ever collected from it or associated with it, regardless of your subscription status.

The premium features of the App are protected by intellectual property laws, and you may not use the premium features in any way that infringes on our intellectual property rights. You agree not to share, distribute, or exploit the premium features or any content generated through them for commercial purposes, without our prior written permission.

Data Management and User Control

All User Content, including original photos, generated oil-painting images, and creation history, is stored exclusively on your local device, regardless of whether you have a Premium Subscription. We do not collect, store, sync, or back up any of this data to our servers or any third-party servers. You have full control over your User Content, with the right to save, view, share, or delete it at any time.

When you delete a creation record, an original photo, or a generated oil-painting image within the App, the data is permanently removed from your device’s local storage. We do not retain any copies of the deleted data, and there is no way to recover it through the App after deletion, as we do not store any backups. Your subscription status does not affect your control over your User Content—you retain full control at all times.

We do not collect any facial data, so there is no facial data to manage, store, or delete, regardless of your subscription status. Even if you delete User Content that contains facial images, you are only deleting the image file itself—there is no separate facial data to delete because we never collected it. Our App does not have any hidden storage or backup mechanisms for facial data, as we have no need for such data and do not collect it under any circumstances. You have full control over your User Content, and your facial privacy is protected because no facial data is ever collected, whether you have a Premium Subscription or not.

Prohibited Uses of Premium Subscription

You agree not to use the Premium Subscription or any of its features for any illegal, unethical, or harmful purposes, including but not limited to:

We do not collect any facial data, and we prohibit any use of the Premium Subscription that attempts to collect, extract, or process facial data from any user or any User Content. Any attempt to use the Premium Subscription to collect or process facial data is a violation of this Agreement, and we reserve the right to take appropriate action, including restricting or terminating your access to the Premium Subscription. We have no mechanisms in place to collect facial data, and any unauthorized attempt to extract facial data from the App or its User Content (whether using basic or premium features) is strictly prohibited.

Subscription Modifications and Updates

We may from time to time update the Premium Subscription features, pricing, or terms to improve functionality, fix bugs, enhance security, or add new features. These updates may be automatic or require your explicit consent to download and install. By maintaining a Premium Subscription, you agree to receive and install these updates, as they may be necessary to ensure the premium features function properly and securely.

We reserve the right to modify the terms of the Premium Subscription (including pricing) at any time, but we will provide reasonable notice to subscribers of any significant changes. If you do not agree to the modified terms, you may cancel your subscription before the changes take effect. Your continued use of the Premium Subscription after the changes take effect constitutes your acceptance of the modified terms.

All updates and modifications to the Premium Subscription will continue to adhere to our commitment of not collecting any facial data. We will never add any premium features or functionality that collect, process, or transmit facial data, and any updates will not include any facial recognition technology or mechanisms designed to extract facial data. Even after updates, all processing of User Content (including photos with facial images) will remain local on your device, and no facial data will be collected, stored, or sent to any external servers. Our commitment to protecting your facial privacy is unchanged by any subscription updates or modifications.

Disclaimer of Warranties

The Premium Subscription and its features are provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding the Premium Subscription’s functionality, performance, accuracy, reliability, or availability. We do not guarantee that the premium features will be error-free, uninterrupted, or free from viruses or other harmful components. You use the Premium Subscription at your own risk, and we are not liable for any damage to your device, data, or User Content resulting from your use of the Premium Subscription.

We do not collect any facial data, and this disclaimer of warranties does not affect our commitment to protecting your facial privacy. We make no representations or warranties regarding facial data collection because we do not collect any facial data in the first place. Your facial privacy is protected regardless of the Premium Subscription’s performance or functionality, as no facial data is ever collected by the App or in connection with the Premium Subscription.

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Premium Subscription, including but not limited to damages to your device, data loss, or any other harm, even if we have been advised of the possibility of such damages. This limitation of liability applies regardless of the cause of action, whether in contract, tort, or otherwise.

Since we do not collect any facial data, we shall not be liable for any damages related to facial data collection, misuse, or disclosure, as no such data is ever collected by the App or in connection with the Premium Subscription. You will never incur damages related to facial data privacy breaches from the Premium Subscription, as we have no facial data to breach. Our limitation of liability does not affect our commitment to not collecting facial data, and we shall not be held liable for any claims related to facial data collection, as we do not engage in such practices.

Termination

We reserve the right to terminate or suspend your access to the Premium Subscription at any time, without prior notice, if you violate any term of this Agreement or the App’s User Agreement. Upon termination, you will no longer have access to the premium features, but you will continue to have access to the App’s basic free features. You will not be entitled to a refund for any unused portion of the subscription period, except as required by applicable law or the app store’s refund policies.

You may terminate your Premium Subscription at any time by canceling it through the applicable app store’s subscription management settings, as described in Section 19 (Subscription Renewal and Cancellation).

Upon termination of your Premium Subscription, we will not retain any of your data, including any facial data (which we never collected in the first place). Since we do not collect any facial data, there is no facial data to retain or delete upon termination. Your User Content remains on your local device, and you retain full control over it even after your access to the Premium Subscription is terminated. Termination of your Premium Subscription does not affect our commitment to not collecting facial data, as we never collected any such data during your use of the Premium Subscription.

Changes to This Agreement

We reserve the right to modify or update this Agreement at any time. When we make significant changes to the Agreement, we will notify you through the App (e.g., via a pop-up notification) or through other reasonable means. Your continued use of the Premium Subscription after the changes take effect constitutes your acceptance of the modified Agreement. If you do not agree to the modified Agreement, you must cancel your subscription before the changes take effect.

Any changes to this Agreement will not include any provisions that allow us to collect facial data. Our commitment to not collecting any facial data is a core principle of the App and the Premium Subscription, and we will never modify this Agreement to permit the collection, processing, or transmission of facial data. Any updates to the Agreement will reaffirm our commitment to not collecting facial data, and we will clearly communicate any changes that may affect your privacy, though no such changes will involve facial data collection.
